Fuel prices shown on BowserWars are indicative only. Prices at the pump may differ from those displayed. Do not rely on BowserWars data as a substitute for checking actual pump prices before purchasing fuel.
1. Acceptance of Terms
By accessing or using bowserwars.com.au (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and BowserWars ("we", "us", "our").
These Terms are governed by the laws of Western Australia, Australia.
2. Description of Service
BowserWars provides an online platform that aggregates, displays, and analyses Australian fuel price data obtained from government APIs, third-party data providers, and community submissions. The Service includes:
- Fuel price comparison for Australian capital cities
- Station-level price search by postcode
- Price history charts
- Daily morning briefing emails (Pro feature)
- Community price reporting
3. Disclaimer — Fuel Price Data
Prices displayed on BowserWars are indicative only and may not reflect current pump prices.
- Government-sourced prices (NSW, WA, VIC) are updated periodically and may be up to 24 hours old.
- Prices for states without a mandatory reporting scheme (QLD, SA, ACT, NT) are estimates based on historical trends and community reports.
- Prices can change multiple times per day. A price shown as "live" reflects the most recent data received, not necessarily the price at the moment you arrive at a station.
- BowserWars makes no representation or warranty as to the accuracy, completeness, or timeliness of any price information.
BowserWars accepts no liability whatsoever for any loss or damage arising from reliance on fuel price data displayed on this Service. This includes but is not limited to: wasted journeys due to incorrect prices, decisions to delay or accelerate fuel purchases, or any financial loss arising from price information.
4. User Accounts and Pro Subscription
4.1 Account registration
To access Pro features, you must provide a valid email address and payment method. You are responsible for maintaining the confidentiality of your account credentials.
4.2 Subscription plans
BowserWars Pro is available on the following plans:
- Monthly: $2.00 AUD per month
- Annual: $16.99 AUD per year (save 29% vs monthly)
All prices are in Australian Dollars (AUD) and include GST where applicable. Subscription payments are processed by Stripe.
4.3 Billing and renewal
Subscriptions are billed immediately upon signup. Subscriptions automatically renew at the end of each billing period. You authorise us to charge your payment method on file. We will notify you of any price changes at least 30 days before they take effect.
5. Cancellation Policy
You may cancel your Pro subscription at any time through your account settings or by contacting us at hello@bowserwars.com.au.
- Monthly subscribers: Cancellation takes effect at the end of the current billing period. You retain Pro access until then.
- Annual subscribers: Cancellation takes effect at the end of the current annual period. No partial refunds are issued for unused months unless required by Australian Consumer Law.
6. Refund Policy
We offer refunds in the following circumstances:
- Within 7 days of initial purchase: Full refund if you have not used any Pro features (including price alerts).
- Service outage: Pro-rated refund or credit if the Service is unavailable for more than 72 consecutive hours.
- Australian Consumer Law: You may be entitled to a refund, repair, or replacement under the Australian Consumer Law if the Service has a major failure.
To request a refund, contact hello@bowserwars.com.au with your account email and reason for the refund request.
7. Acceptable Use
You must not use the Service to:
- Scrape, harvest, or systematically extract data without our written consent
- Submit false or misleading community price reports
- Attempt to interfere with or disrupt the Service or its infrastructure
- Use the Service in violation of any applicable law or regulation
- Resell or redistribute Service data without a commercial data licence
8. Intellectual Property
All content, design, software, and data presented on BowserWars (excluding third-party government data, which remains the property of the respective government agencies) is owned by or licensed to BowserWars. You may not reproduce, distribute, or create derivative works without our written permission.
9. Limitation of Liability
To the maximum extent permitted by law, BowserWars is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
Nothing in these Terms limits or excludes liability which cannot be limited or excluded under the Australian Consumer Law.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
